You must be at least 18 years old to register for an account with BuyBritain.com, to buy or sell through the website. By registering an account or making a purchase, you confirm that you are over 18.
1.4 Be polite & respectful
Feel free to browse through the Buy Britain listings and interact with the sellers, however, do not leave rude, offensive, misleading or false messages for anyone in the Buy Britain community. Buy Britain reserves the right to remove any messages or content from the website at its own discretion.
1.5 Buy Britains’s role
BuyBritain.com is a marketplace. When you buy or sell a product, the contract is strictly between the buyer and seller and Buy Britain is neither a party nor an agent for anyone else in relation to that contract.
1.6 Buy Britain’s liability
Buy Britain is proud to work with high-quality UK-based sellers and takes care to ensure that its sellers are honest and responsible. However, Buy Britain is not liable in any circumstances whatsoever, including for Buy Britain’s negligence:
- to any purchaser for the quality, fitness for purpose, compliance with description or lawfulness of the product supplied by the seller
- if the seller does not provide the product
- if there are issues with delivery/shipping of the product
- if there are issues with the buyer’s payment for the product
- to ensure the safety of any product
Buy Britain provides a message system for buyers and sellers to communicate with each other. This is not a private communication channel, and Buy Britain administrators have access to and may monitor any communication taking place on the website. You agree not to use the message system to send any offensive material or comments to any person. You also agree not to use the message system to arrange any transactions outside the process provided by Buy Britain, to share contact details, including website details or otherwise avoid the commission due to BuyBritain on each sale. Any person found breaching this provision is likely to have their account with Buy Britain terminated immediately.
1.9 UK Consumer Laws & Overseas Trade
All Buy Britain sellers must comply with any and all relevant UK legislation regarding the sale of goods, both in general terms and relevant to their sector.
Sellers must comply with any regulations required for exporting their goods to overseas sellers who have purchased through BuyBritain.com. Buy Britain is not liable for any overseas regulations or taxes. Sellers are wholly accountable to comply with local laws and pay any international tariffs or taxation.
1.10 Special tags / Badges
Buy Britain has a number of ‘special tags’ to highlight products with special features. Here we define the meaning of those tags:
‘100% British’ – a product where all raw materials were sourced from the UK, and all manufacturing occurred in the UK. For clarity, this applies to the product not the to packaging (although we would encourage the use of locally sourced, eco-friendly packaging where possible).
‘Exclusive to Buy Britain’ – a product which is only sold online at BuyBritain.com (and through Buy Britain’s online channels). For clarity, the product may be sold elsewhere ‘offline’, for example in a physical store.
2.0 Special Terms for Buy Britain Sellers
2.1 Made in United Kingdom: direct from the UK-based maker
The Buy Britain website is a marketplace for goods made in the United Kingdom (England, Scotland, Wales & Northern Ireland). Buy Britain welcomes sellers from the United Kingdom to open an account with us to sell any items the seller has made within the United Kingdom. They can sell directly to a UK based and global audience.
What does ‘made in Britain’ mean to us at Buy Britain? Firstly we think it means great design, high-quality craftsmanship and local manufacturing. So we want to work with vendors who have similar values. Secondly, we look at the level to which something has been ‘made in Britain’. This is not a simple standard to set, as manufacturing supply chains can be complex. So we have created two ‘standards’ for products on our site:
- ‘Made in Britain’ – Products in this category have been majority crafted and manufactured within the UK. These products could use some supplies and materials which are imported (For example Italian Leather, or American Oak). We think it is absolutely right for manufacturers to select the finest materials available to craft their products. However, the majority of craftsmanship and manufacturing must occur within the UK.
- ‘100% British’ – Products in this category have been entirely crafted and manufactured locally within the UK. These products are made using locally UK sourced materials.
We operate on a ‘trust but check’ basis. This means that we trust our sellers to do the right thing and only use our platform to sell products made in the UK. However, we know that sometimes, some individuals can try to abuse online systems or mistakes can be made. Therefore we have a moderation and ‘report abuse’ system across all products on the site. All products are moderated before going live on site and the report abuse system allows visitors to flag to site moderators if they believe that a product is not manufactured in the UK.
The onus is on sellers to provide evidence against these standards and to self certify which of these standards their products meet. As a small company we cannot yet vet all products individually. However we also have a reporting and moderation system, so that any abuse of the platform can be raised to us to inspect. Buy Britain reserves the right to remove any products from the site which we deem do not meet the standards above. If a seller feels that their product has been removed unfairly, they may contact Buy Britain to discuss the matter and provide further evidence in favour of that product.
Buy Britain may remove listed items or close sellers’ accounts if the goods offered are not, in Buy Britain’s sole and unfettered discretion, items associated with (made by) the seller in the United Kingdom. Buy Britain will always attempt to discuss this with the seller first. There is room for discussion as to whether items are sufficiently associated with the seller. Generally, but without affecting Buy Britain’s absolute discretion, an admissible item will have one or all of the following qualities:
- It is a unique design, designed by the seller
- It has been substantially made by the seller in the United Kingdom
- It has some factory made components, but these are assembled by the seller in a creative way, or in a way requiring unique or special skill
2.2 Additional United Kingdom Verification
Sellers must provide a valid United Kingdom address and phone number. We may also ask that sellers to provide satisfactory evidence that they manufacture in the UK. It is Buy Britain’s sole discretion as to whether the evidence provided is satisfactory.
Sellers must ensure that the product they are offering for sale conforms with all United Kingdom laws. Without limiting the generality of this provision, sellers must ensure the following in relation to products offered for sale on the website:
- that all food products comply with the Food Safety Act and any regulations in force
- that products do not breach Copyright or Trade Mark legislation, or the intellectual property rights of any third party
- that all products comply with safety regulations in force in the United Kingdom. Particular care needs to be taken for products sold as suitable for infants under three years old, as there are laws relating to (for example) choking hazards and flammability. However, it is the seller’s responsibility to ensure all products comply with ALL United Kingdom laws
- the VAT inclusive sale price is listed in UK GBP in the listing for each product
If Buy Britain has concerns about the legality of any items offered for sale, it reserves the right to remove the listings immediately and will not relist the items unless it is satisfied, in its own opinion entirely, that the items comply with the law. Buy Britain will attempt to communicate with the seller in regard to removing any items from that seller’s listing.
2.4 Listing requirements
When listing products on the website, sellers must:
- clearly state the sale price in UK GBP and including VAT (if the seller is registered)
- clearly set out any delivery / shipping prices and conditions (Delivery / Shipping is the seller’s responsibility)
- describe the product faithfully without any misleading details or omissions
- list the product in an appropriate category or categories
- remove the listing when the product is not available
- avoid placing any contact details for the seller on the listing
- own the copyright for any photographs uploaded to the website
- grant the right for Buy Britain to use any details listed, and any material submitted in a listing for promotion of the website.
In addition, sellers must post the product to buyers promptly upon payment. If a seller defaults on delivering an order and the buyer is not refunded their payment in full, Buy Britain will invoice the seller for the amount in question, plus an administration fee per undelivered purchase. If recovery action is required to recover any such balance, the seller will pay all debt recovery costs.
Duplicate listings of the same item are considered spam and excessive identical listings will be removed.
Items listed in inappropriate categories will be moved to a suitable category or removed at Buy Britain’s discretion.
2.5 Submitted material
When you upload photographs and other content to the website you give consent to Buy Britain to use the photos and other content for any purposes related to promotion of the community or the website.
2.6 Payment and payment accounts
To provide users with the best checkout experience, Buy Britain has chosen to use Stripe for payment processing. Sellers should setup their own Stripe account (or connect an existing one). This can be done in the seller’s Buy Britain dashboard area. Stripe allows buyers to easily pay with a wide range of debit and credit cards. It also makes payment between buyer, seller and platform (Buy Britain) automated and easy to manage. Please note that any payment fees charged by Stripe are a separate contract between Stripe and the Seller. All payments compliance and regulatory matters are the responsibility of Stripe.
If the seller has not connected Stripe then it is possible to request a withdrawal via bank transfer. This is a manual process and therefore sellers need to allow more time for a manual bank transfer. Via bank transfer we have set a minimum withdrawal of £50. Funds must also have been cleared for 14 days before the request can be made. Then sellers need to allow manual processing time (expect a working week) for the withdrawal to be processed from our end plus any settlement and processing time between the banks.
Sellers pay any and all payment processing fees charged by Stripe. These are charged by Stripe at their standard rates. These will be deducted from sales revenue automatically along with our Commission. These are currently 1.4% + £0.2 for UK and European cards. Buy Britain is not liable for payment processing charges. Buy Britain also does not add anything to payment processing charges or profit from them in any way.
We will continue to invest in improving our service and may enable further payment methods in the future.
2.7 Commission payable & platform costs
Unlike other marketplace platforms, Buy Britain does not charge sellers any joining fees, membership fees or listing fees. Yes, it is free to sign up to BuyBritain.com as a seller, it is free to list your products (in multiple categories) and it is free to be on the platform selling to a global audience. This is because we want to keep costs clear, simple and easy to manage for our sellers. As such we have chosen a model which is based on one clear commission fee payable on sales.
Each product sold on BuyBritain.com is subject to a 9% commission on the sale price. This is the only fee payable to Buy Britain. So sellers only pay when they sell. We believe this is a fairer approach than charging sign-up fees or listing fees. Commission is taken automatically through our payment system. The majority of commission is re-invested into the BuyBritain.com platform and used to promote the platform (which benefits our sellers). As our platform grows we commit to using a UK based workforce. So our commission will also support high-skill digital jobs based in the UK.
To support this Buy Britain requires that sellers do not post their contact details, including website details and links on the website for the purposes of making contact with buyers outside of the Buy Britain sale process for the purposes of concluding a sale. Sellers may not make arrangements through the Buy Britain website, or with Buy Britain buyers, to conclude a sale outside the Buy Britain system for sales. If Buy Britain becomes aware that this has occurred, it will take action against the seller, which may include claiming any lost commission and terminating the seller’s account.
Buy Britain reserves the right to change its platform costs policy at its sole discretion.
2.8 Current information
Please make sure you supply correct current information to Buy Britain, including your personal details, business details and correct payment details. It is your responsibility to update these details any time they change. Buy Britain will not be responsible for any losses caused to you due to your failure to provide correct and updated personal information and payment details.
We would request sellers to remain active on the platform and monitor their shops regularly. If Buy Britain believes that a shop has become inactive for significant period of time we reserve the right to remove that store and its products. In this unlikely eventuality we would endeavour to contact the seller before removal of the store.
2.9 Closing accounts
Buy Britain reserves the right to cancel any seller’s account at any time, without specifying a reason, by sending a message to the seller to the email address specified at registration.
A seller may terminate their account at any time by giving one week’s notice to BuyBritain at the email address email@example.com
Upon termination or suspension of a seller’s account, all commission still payable and any other sum owing remains payable to Buy Britain and must be paid immediately.
Buy Britain only collects your personal data for the purposes of administering the website, your listings and for charging commission. Your personal details are not made available to any third parties for purposes other than administration of the Buy Britain website.
Where Buy Britain uses third parties (or third party applications) to undertake services, we may provide those third parties with some of your information if it is required to fulfil those services. We use third party software such as customer relationship management, marketing automation and accounting software that holds your information, sometimes overseas. We require any third party to undertake strict precautions to protect your information against unauthorised use or disclosure.
You are entitled to access your personal information and request changes where the information is incomplete or incorrect. BuyBritain will respond to any privacy request within a reasonable time.
2.11 Community communication
The BuyBritain website is the community of sellers who support and encourage each other and support the UK economy. As a Buy Britain seller you agree that you will not post any material or comments that could be taken as offensive by another seller, and will not post any material which could be defamatory of any party on the website.
If you have concerns about any aspect of another seller’s listings, you are entitled to make a complaint to Buy Britain by sending an email to firstname.lastname@example.org. Buy Britain will carefully consider all complaints made. Products also have an abuse reporting system which is monitored by site admins.
3.0 Special Terms For The Buy Britain Wine Club
The Buy Britain Wine Club is a trading style of Buy Britain Ltd. As such all references to the Buy Britain Wine Club, its website and its Terms & Conditions, are to be read in conjunction with our general Terms & Conditions above.
By using the Buy Britain Wine Club website, you agree to be bound by the terms and conditions set out within it and the wider Buy Britain website. Nothing in these terms and conditions affects your statutory rights as a consumer, or otherwise.
Any liability under these terms and conditions cannot exceed the total price of your order.
The Buy Britain Wine Club is not responsible for any business loss or damage which does not result directly from their actions, or that was unforeseeable at the time of ordering.
3.2 Placing an order
When you place an order via our website, it is classed as an offer, which if accepted by us results in a binding contract. By completing the checkout process on the Buy Britain Wine Club website, you are also agreeing to all of our Terms and Conditions as presented on the website.
Should we accept your order, you will be sent an email containing the details of your order. Once this email has been sent, it means the order has been accepted, a contract has been formed, and payment will be taken. If, in the unlikely event, your order is not accepted, we will notify you via email of why this is the case, and no payment will be taken.
It is your responsibility to check all the information in the confirmation email is correct, and notify us immediately via email should there be any inaccuracies. We will not be liable for reimbursing you for the value of any goods which have perished or been damaged as a result of your failure to inform us of inaccurate information being listed on the confirmation email.
3.3 Cancelling an order
Should you wish to cancel an order that has been accepted by us, and a confirmation email has already been sent out to you, we are unable to guarantee that we can cancel the order, and provide a full refund. However, if you email us as soon as possible, and your items have not yet been dispatched, we will endeavour to cancel your order and refund you in full without charge. In cases where your wine has already been cut and packaged though, this will not be possible.
3.4 Product description
All of the product images on our website are for illustrative purposes only. As such, products and their packaging may vary from the pictures on the website. The products offered by the Buy Britain Wine Club are constantly rotated and adapted.
Therefore, whilst we try to provide indications of which wines and products you may receive within your delivery, and how they might look, we reserve the right to deliver wines that have not been indicated or explicitly referred to anywhere on the website.
We strive to take into account preferences as indicated by you, the customer, when you place an order.
We use Parcelforce 24 for all of our deliveries. We believe they are the best couriers in the market, with a completion rate very close to 100%.
We are able to deliver to both residential addresses and business addresses. Before completing your purchase, you must indicate instructions for the courier as to where your delivery should be left in the event nobody is present to receive the order. This is not a signed for service, so it can be simply ‘on the porch’, as well as ‘with a neighbour’. It is important that you are as specific as possible with these instructions.
Please note that should your indicated preference not be secure, we are unable to assume liability for loss or damage incurred as a result of the wine being left in/at that location. If our couriers deem a ‘safe place’ location not to be secure, either because it is exposed to the elements, or it is visible from the road, they may return to the depot with it. In such cases, you will be informed via the tracking service (text message and/or email) and with a slip through the letterbox. You can then either arrange re-delivery directly with them for the next day, or to collect from the depot. This should be done the following day to ensure the wine remains in pristine condition. We can accept no liability if you are unavailable to either receive or collect your delivery the day following the scheduled delivery date where the ‘safe place’ has been deemed insecure by the courier.
On the very rare occasion your wine does not arrive on the chosen delivery day, it is very likely to arrive the next day.
If your wine has not arrived by the end of the next day, then please let us know as soon as possible, and we will investigate.
If there is nobody available to receive the delivery, or collect it, on either the day of delivery, or the following day, we are unable to offer any refunds or compensation provided the original delivery was delivered on one of those days.
It is therefore imperative that you ensure someone is available to either receive or collect the delivery on either the day, or the day after the scheduled delivery date.
Payment for regular subscriptions will always be taken from the credit or debit card you used to sign up. It will be taken on the same date each month or quarter (the date you signed up). Regular subscriptions must be cancelled 1 week prior to your payment date. We are unable to cancel your delivery if you cancel after this period. If cancellation is made at least 1 week in advance of your billing date, your subscription will be cancelled free of charge. You can update or cancel your subscription by visiting the subscriptions page on your Buy Britain account.
3.7 Complaints procedure
In the unlikely event that you are unhappy with the condition of any of the products that you receive, please let us know immediately via email, including photographic evidence, and we will take any necessary action.
If you do not inform us of a problem within 5 days of receipt of the order, or you do not provide any photographic evidence relating to the complaint, we will be unable to accept your claim, or provide a refund.
